1. Who we are and what these terms cover
Korbel (we, us, the Service) is a directory and showcase of building projects, the companies involved in them, and the products used. These terms apply to everyone who uses the Service, whether a visitor, a company with an account, or anyone submitting content. By using the Service you agree to these terms. If you use the Service on behalf of a company, you confirm you are authorised to do so, and the word you includes that company.
2. The nature of the information on this site
Content on the Service, such as project details, company involvement, roles, product information, images, and descriptions, is largely submitted by third parties or compiled from public sources. We review submissions before publication, but we do not verify, audit, or guarantee any of it. Nothing on the Service is a recommendation, endorsement, or professional, financial, or procurement advice. You must make your own enquiries before relying on anything you find here, including before engaging any company listed.
3. Accounts and registration
Registering creates an account for a company. You must provide accurate information, register only a company you genuinely represent, keep your login details secure, and be at least 18. You are responsible for all activity under your account. New registrations are reviewed, and we may approve, decline, or remove any account or listing at our discretion, without being required to give reasons. One login manages one company. We may reassign who manages a company page where we reasonably believe someone else is the rightful representative.
4. Claims of project involvement
When you claim a role on a project or submit a project, you confirm the claim is true and that you are entitled to make it. We may request evidence, and we may approve, decline, edit, or remove claims and listings at any time. Making false or misleading claims is a breach of these terms and may also breach the law. You are solely responsible for the accuracy of your claims and listings.
5. Content you submit
You keep ownership of content you submit, such as text, logos, photos, product information, and links. By submitting it, including through the public submit a project form, you grant us a worldwide, non-exclusive, royalty-free, perpetual licence to host, store, reproduce, adapt (including cropping and resizing images), publish, and display that content on the Service and in material promoting the Service. You confirm that you own the content or have all rights needed to grant this licence, that it does not infringe anyone else's rights (including copyright in photographs) and does not break any law or confidentiality obligation, and that you are solely responsible for it. We may edit, decline, or remove any content at any time. If a photographer or other rights holder objects to an image you submitted, responsibility rests with you as the submitter.
6. Acceptable use
You must not misrepresent your identity or involvement in any project; submit content that is false, defamatory, infringing, offensive, or unlawful; scrape, bulk-download, or systematically extract data from the Service; interfere with or attempt to bypass the Service's security or rate limits; use another account's credentials; or use the Service to spam or harass anyone. We may suspend or terminate accounts that breach this section.
7. Subscriptions and payment
Some features require a paid subscription. Prices are shown on the Service and are processed by our payment provider, and by subscribing you also agree to that provider's terms. Subscriptions renew automatically each billing period until cancelled. You can cancel any time from your dashboard. Cancellation stops future charges, and access continues to the end of the paid period. Except where the law requires otherwise, payments are non-refundable. We may change prices with reasonable notice, applying from your next billing period. We may also grant free access at our discretion and withdraw it at any time.
8. Badges and featured placement
Any badge or featured placement on the Service is provided at our discretion. It is not an endorsement, quality mark, or verification of any company's work.
9. Availability and changes
The Service is provided as is and as available. We may change, suspend, or discontinue any part of the Service at any time, and we do not guarantee uninterrupted or error-free operation, or that content will be preserved. You are responsible for keeping your own copies of content you care about.
10. Intellectual property
The Service's software, design, branding, and compilation of data are owned by us or our licensors. Except for viewing the Service in the ordinary way, you may not copy, adapt, or reuse them without our written permission.
11. Third-party services and links
The Service relies on third-party providers and links to third-party websites, such as company and product websites. We are not responsible for third-party services or their content.
12. Liability
To the maximum extent permitted by law, we exclude all warranties and guarantees not expressly set out in these terms; we are not liable for any indirect or consequential loss, or loss of profit, revenue, data, or opportunity; and our total liability to you in connection with the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or 100 dollars if you have paid nothing. Nothing in these terms limits rights that cannot be excluded by law.
13. Your responsibility for claims
You agree to cover us for any loss, damage, cost, or claim (including reasonable legal costs) arising from content you submit, claims you make about project involvement, your breach of these terms, or your breach of any law or third-party right.
14. Suspension and termination
We may suspend or terminate your access at any time, including for breach of these terms or suspected false claims, and we may retain or remove your content as described in section 5. You may stop using the Service at any time. Contact us to close your account.
15. Changes to these terms
We may update these terms from time to time by posting the new version here with an updated date. Continuing to use the Service after a change means you accept it. For material changes affecting paid subscriptions, we will give reasonable notice.
16. General
These terms are governed by the laws that apply where we operate, and the courts there have jurisdiction. If any part of these terms cannot be enforced, the rest remains in effect. A failure to enforce a term is not a waiver of it. These terms are the entire agreement between us regarding the Service.
